Terms of Service

This Terms of Service Agreement (“Agreement”) is between you and Kanji Bird (“Kanji Bird”, “we”, “us”, or “our”) and governs your use of the Kanji Bird website and any related applications or services (collectively, the “Service”). By accessing or using the Service you agree to be bound by this Agreement. If you do not agree, do not use the Service.
1. Use of the Service
1.1 What Kanji Bird is
Kanji Bird is a Japanese language learning tool that lets you practise hiragana, katakana, kanji, and vocabulary through an interactive flashcard game. All JLPT card data and app software are the proprietary property of Kanji Bird and its licensors. No ownership rights in or to the Service are transferred to you by this Agreement.
1.2 Your content
Any custom flashcard decks you create (“User Content”) remain your property. By submitting User Content you grant Kanji Bird a non-exclusive, royalty-free licence to store and display that content solely for the purpose of operating the Service for your account.
1.3 Accuracy of learning content
JLPT card data, readings, meanings, and other learning content are provided for educational purposes only. We make reasonable efforts to ensure accuracy but do not warrant that all content is error-free. You should verify critical language information against authoritative references.
2. Eligibility
You must be at least 13 years of age to create an account or use the Service. By using the Service you represent that you meet this requirement. If you are under 18, you represent that a parent or guardian has reviewed and agreed to this Agreement on your behalf.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorised use. We reserve the right to suspend or terminate accounts that violate this Agreement.
4. Updates
The Service is continuously evolving. We may add, change, or remove features at any time with or without notice. We may also require you to accept updates to any installed application in order to continue using the Service.
5. Use Restrictions
You agree not to:
- License, sell, rent, transfer, or commercially exploit the Service or any portion of it without our prior written consent.
- Modify, reverse-engineer, decompile, or create derivative works of the Service, except as expressly permitted by applicable law.
- Use automated tools (scrapers, bots, crawlers, etc.) to extract data from the Service, or use Service data to train artificial intelligence or machine learning models without our written permission.
- Access the Service in order to build a competing product or service.
- Transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
- Attempt to gain unauthorised access to any part of the Service or its related systems, or interfere with the proper functioning of the Service.
- Remove or modify any proprietary markings or copyright notices in the Service.
6. Ownership and Intellectual Property
6.1 Kanji Bird property
“Kanji Bird” and associated logos, trademarks, and trade names are the property of Kanji Bird and may not be used without our prior written permission in connection with any third-party products or services.
6.2 Feedback
If you submit ideas, suggestions, or other feedback about the Service, you grant Kanji Bird a perpetual, irrevocable, royalty-free licence to use and incorporate that feedback in any way, without compensation or attribution to you.
7. Third-Party Services
The Service relies on third-party infrastructure including Firebase (Google) for authentication and data storage. The Service may also contain links to third-party websites or services. Kanji Bird is not responsible for the content or privacy practices of any third-party site or service, and your use of them is at your own risk and subject to their terms.
8. Indemnification
You agree to indemnify and hold Kanji Bird and its officers, employees, agents, and licensors harmless from any losses, costs, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of this Agreement; (c) your violation of any third-party rights; or (d) your violation of applicable law.
9. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis. Kanji Bird disclaims all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that any content (including learning data) is complete or accurate.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Kanji Bird and its officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of data, revenue, or goodwill) arising out of or related to your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our aggregate liability to you for all claims arising out of this Agreement shall not exceed one hundred US dollars (USD $100).
11. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into this Agreement by reference.
12. Governing Law
This Agreement is governed by and construed in accordance with applicable law. Any disputes arising under this Agreement shall be resolved in the jurisdiction where Kanji Bird is headquartered, and you consent to the personal jurisdiction of the courts in that jurisdiction.
13. General Provisions
13.1 Entire agreement
This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and Kanji Bird regarding your use of the Service and supersedes all prior agreements.
13.2 Assignment
You may not assign your rights or obligations under this Agreement without our prior written consent. We may freely assign our rights and obligations.
13.3 Severability
If any provision of this Agreement is found to be invalid or unenforceable, that provision will be limited to the minimum extent necessary so that this Agreement otherwise remains in full force and effect.
13.4 Waiver
Our failure to enforce any provision of this Agreement on one occasion will not be deemed a waiver of that provision or any other provision.
13.5 Changes to this Agreement
We reserve the right to update this Agreement at any time. Material changes will be communicated by updating the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Agreement.
13.6 Force majeure
Kanji Bird shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including acts of God, war, natural disasters, or failures of third-party infrastructure.
13.7 Electronic communications
By using the Service you consent to receive communications from us electronically. These electronic communications satisfy any requirement that communications be in writing.
